Throughout the site, the terms "we", "us" and "our" refer to Fish Farm Samples, the "buyer" or "you" refers to you who pays for the license fee. By visiting our site and/ or purchasing something from us, the Buyer engages in our "Service" and agrees to be bound by the following terms and conditions ("Terms of Service", "Terms")
Upon the Buyer's payment of the license fee ("License Fee") for the applicable sound recording and/or sample obtained from this website (referred "to as "Sample"), the Buyer is granted a non-exclusive, non-transferable, perpetual right to publicly perform, distribute, or transmit the Sample in combination with other sounds in music productions to create new recordings ("Recording(s)"). These recordings are considered "derivative works" as defined in the United States Copyright Act of 1976, as amended. Subject to the following terms and conditions, the Buyer is authorized to modify, reproduce, and utilize the Sample as part of the Buyer's Recording.
(i) The Seller hereby sells and transfers ownership of the Sample to the Buyer.
(ii) The Buyer acknowledges that the Seller retains the copyright ownership of the Sample.
(i) The Seller grants the Buyer a non-exclusive, non-transferable license to use the Sample in the production and sale of a Recording created by the Buyer.
(ii) The license granted herein allows the Buyer to use the sample solely in connection with the Recording, including reproduction, distribution, public performance, and sale of the Recording
(iii) The buyer may not use or sublicense any Sample in isolation as sound effects, loops, or as source material for any other form of sample, regardless of whether or not the Sample is modified by the buyer.
(iv) The following actions are strictly prohibited: redistribution of any Sample in new sample packs, sub-licensing, selling, loaning, renting, sharing, lending, leasing, assigning, distributing, or transferring any Sample to a third party, unless it is incorporated into a Recording.
(v) Without obtaining the express written consent of the artist, producer, and/or writer associated with the Sample, the Buyer is prohibited from using their name, image, likeness, or any other identifying characteristics in any way.
i) The Buyer shall have the right to modify, adapt, arrange, and synchronize the Sample with the Song as necessary for the creation of the final Recording.
i) In consideration for the sale of the Sample, the Buyer shall pay the Seller the agreed-upon purchase price as listed.
ii) The Seller shall have no further claim to royalties or any other compensation arising from the sale, distribution, or performance of the Recording by the Buyer.
i) The Buyer shall indemnify and hold the Seller harmless from any claims, damages, or liabilities arising out of or related to the Buyer's use of the Sample in the Recording, including any infringement of third-party rights.
This Agreement shall be governed by and construed in accordance with the laws of California, USA. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of California, USA.
The buyer may not use our products for any illegal or unauthorized purpose nor may the buyer, in the use of the Service, violate any laws in the buyers jurisdiction (including but not limited to copyright laws).
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
This Agreement constitutes the entire understanding between Fish Farm Samples and the Buyer concerning the subject matter hereof.
